This document describes the Terms and Conditions under which Greenpeace offers the service for Greenpeace Giving www.greenpeacegiving.org.nz. Any questions should be sent to info@greenpeace.org.nz
Please read these Terms and Conditions carefully. Upon commencement of use of this site, you are deemed to have accepted, and will be bound by the Terms and Conditions contained within this Users Agreement, as amended and varied from time to time.
1.1 Terms and conditions
(a) The meaning of defined terms used throughout this Users Agreement is contained in Clause 5 of this Users Agreement.
(b) This User Agreement sets out what you must do and what you must not do when using the service. It also sets out our obligations to you. These are important conditions for the use of the service. If you breach any of these conditions, we may decide not to allow you to participate in the service or if necessary claim damages against you. Please take time to read this Users Agreement and make sure you understand it. If you have any questions, please read our 'How it works' pages. If these pages do not answer your question, please contact us at info@greenpeace.org.nz
(c) We may amend these Terms and Conditions from time to time by posting new Terms and Conditions on this site. These amendments take effect from the time of posting. You should review these Terms and Conditions from time to time for any amendments. Continued use by you of the service following any amendments to these Terms and Conditions will constitute your acceptance of the new Terms and Conditions applying to the service.
(d) Please note that additional conditions governing the service and your relationship with us are contained in other Greenpeace website pages and unless those conditions conflict with these Terms and Conditions, they will be incorporated into and will form part of the Terms and Conditions contained in these Terms and Conditions.
1.2 Use of the service
(a) The service is provided to you personally. When using the service, you must not re-sell access to the service to another person or make commercial use of the service, without our prior written consent.
(b) If a government department, government agency or law enforcement agency informs us that there is any information on the site, which is in contravention of, or may contravene, any law, industry code of practice, policy guideline or regulation; we can remove that information from the site.
(c) Without limiting any other remedies available to us, we may suspend or terminate your account if you are suspected or found to have engaged in fraudulent activity in connection with the site.
1.3 Eligibility
(a) To be a user of this online shop you must read, agree with and accept all of the Terms and Conditions contained in this Users Agreement.
(b) Our services are available only to, and may only be used by, individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to persons under 18 years of age. If you do not qualify, please do not use our services.
1.4 Your information
Your information is defined as any information you provide to us in the use of the service.
a) Your Information (including but not limited to any items listed) must not:
i) be false, inaccurate or misleading;
ii) be fraudulent or misleading;
iii) violate any applicable law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, criminal law, anti-discrimination or trade practices/fair trading laws);
iv) be defamatory, trade libellous, unlawfully threatening or unlawfully harassing, contain any viruses, Trojan horses, worms, time bombs, cancelbots, Easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;
v) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.
(b) You are solely responsible for your information. However, we may deal with your information if we deem it necessary or appropriate. For example, if we believe your information may create any liability for us.
1.5.Fees and services
a) Unless otherwise stated, all prices are quoted in New Zealand dollars. You are responsible for paying all fees associated with using our site, including the stated prices of gifts herein.
2. Privacy
Greenpeace has a Privacy Policy
that applies to all members and is incorporated into this Bidders Agreement by reference. You must read and accept our Privacy Policy upon registration in order to use the Greenpeace Giving site and you will continue to be bound by its provisions (and to any amendments we make to the Privacy Policy) in your use of the Greenpeace Giving website.
3. Governing law
This agreement is governed by and must be construed according to the laws of New Zealand.
4. Copyright
Material contained within the site is copyright to Greenpeace New Zealand and may not be reproduced with prior authorisation by Greenpeace New Zealand. Please contact info@greenpeace.org.nz
5. Definitions
Service: means Greenpeace Giving online shop service governed by these Terms and Conditions and any other conditions contained on the site.
Site: the Greenpeace Giving website.
Privacy Policy: Greenpeace New Zealand's privacy policy.
Us/we: Greenpeace New Zealand, 11 Akiraho Street, Mout Eden, Auckland, New Zealand.
Your information: : any information about you provided to us in the use of the service.
